Article 2 - Usage of Website
1. Ateljé hereby grants to you a personal, revocable, limited, non-exclusive, and non-transferable license to use the Website solely for your personal use, which does not include activities related to any commercial, entrepreneurial or professional activity, provided that you comply with the Terms. Notwithstanding the foregoing, you may not modify, translate, decompile, create derivative work(s) of, copy, distribute, disassemble, broadcast, transmit, publish, remove or alter any proprietary notices or labels, license, sublicense, transfer, sell, mirror, frame, exploit, rent, lease, private label, grant a security interest in, or otherwise use the Website in any manner not expressly permitted herein.
2. Purchasing a Product via the Website is only allowed to individuals who are at least 18 years of age. If you are under 18, you may only make purchases with the involvement and consent of a parent or legal guardian.
Article 3 – Applicability
These Terms apply to every offer from Ateljé and to every Agreement that is concluded between Ateljé and the Customer, whether online through the Website or any other website operated by Ateljé, or in person, for example in stores or pop-up stores.
Article 4 - The offer
1. The presentation of Products on the Website or through any other sales channel operated by Ateljé constitutes a non-binding offer. Although Ateljé takes great care to ensure that all information, prices, and availability shown are accurate and up to date, the Customer acknowledges that errors or omissions may occasionally occur or that certain Products may no longer be available at the time of ordering.
2. If an offer has a limited period of validity or is subject to specific conditions, like discounts, this will be clearly stated in the offer.
3. The offer includes a clear and detailed description of the Products offered. Images and specifications are intended to provide the most accurate representation possible of the Products. However, minor differences in colour, design, or packaging of the Product may occur.
4. The Agreement is concluded at the moment the Customer places an order through the Website and receives an electronic order confirmation from Ateljé at the e-mail address provided.
5. The Customer is required to pay the price stated in the order confirmation. Shipping costs, if applicable, will be displayed separately before completion of the order.
6. Ateljé is not bound by obvious mistakes, misprints or clerical errors in the offer or in the order confirmation, which the Customer could reasonably have recognised as such. In such cases, Ateljé reserves the right to correct the error and will notify the Customer accordingly. If the Customer does not agree with the correction, they are entitled to cancel the order or return the Product free of charge.
7. Price adjustments resulting from changes in applicable laws or government measures may be passed on by Ateljé, provided that such adjustments are permitted under applicable consumer protection law.
Article 5 - The order
1. Orders placed on the Website are subject to strict compliance with the procedures described below.
2. Selection of Products: You may, at any time, add Products to your selection by clicking on “ADD TO BAG” and freely modify your online “Cart” containing the selected Products, remove an initially selected Product, modify the quantities ordered or add a Product by clicking on the corresponding items made available within the “Cart.”
3. Identification: After selecting the Product(s), go to “Check Out” to begin the ordering process.
4. It is obligatory to provide the personal information of the Customer collected during an online order as this information is necessary for the processing and delivery of orders as well as the establishment of invoices. This information will be handled in accordance with our Privacy Policy and is strictly confidential.
5. All orders are subject to acceptance and availability. When placing an order you undertake that you are at least 18 years old, that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the Products.
6. An acknowledgement of receipt of the order is sent to the Customer by email. By placing an order,the Consumer accepts the use of electronic mail for the confirmation of the order content by Ateljé. We will process your data in accordance with our Privacy Policy. By placing an order or using our services, you have agreed to our storing and processing of your data and you confirm that any data provided by you are correct and complete.
7. If the Products are no longer available, even after the order has been confirmed, we will let you know as soon as possible. You may then order another Product from our website or, if you wish, cancel the order. Any payment made will be refunded.
8. Ateljé reserves the right to not accept an order from a Customer with whom it is in dispute over a previous order, or if we reasonably believe that you have breached these Terms.
9. Once we have confirmed your card authorisation and sent the order confirmation by email, the Agreement between Ateljé and the Customer is concluded.
10. Any additional charges such as customs duties, import taxes, or clearance fees are the sole responsibility of the Customer, even if these arise in connection with a return or replacement Product provided by Ateljé.
Article 6 - Payment
1. Ateljé accepts payments made via via iDeal, Klarna, Credit card, Apple Pay and PayPal. Ateljés prices are displayed in Euros. Please note if you choose to pay in a currency different to your own “local” currency, then your credit/debit card provider may charge you exchange rate costs. In the event that no later date has been agreed, the payment of need to be paid for before the Customer receives the Product(s), unless otherwise agreed. The Customer is obliged to inform Ateljé immediately of any inaccuracies in payment data provided or communicated.
2. An acknowledgement of receipt of the order is sent to the Customer by email. In accordance with the provisions of the General Data Protection Regulation, the Customer accepts the use of electronic mail for the confirmation of the order content by Ateljé.
3. The acknowledgement of receipt shall include the order number, the total amount of the order, information relating to cost and delivery time, defining features, quantity and price of the Items purchased.
Article 7 - Delivery
1. Ateljé will deliver the Products to the delivery address provided by the Customer within a reasonable time after order confirmation, taking into account the availability of the Products and the delivery destination. Delivery times indicated by Ateljé are estimates only and do not constitute fixed or binding deadlines. Deliveries are carried out only on Business Days.
2. Time of delivery is not of the essence. A reasonable delay in delivery shall not entitle the Customer to compensation, termination of the Agreement, or cancellation of the order, unless such delay is unreasonable within the meaning of applicable consumer protection law. Ateljé is not responsible for refunding shipping costs due to postal or carrier delays.
3. Ateljé shall, moreover, not be liable for any delay in delivery caused by circumstances beyond its reasonable control, including but not limited to customs procedures, strikes, carrier delays, or natural events. In the event of a delay, Ateljé is not obliged to resend the Product or offer a replacement, unless otherwise required by mandatory law.
4. The Customer is responsible for providing a complete and accurate delivery address and contact details. Ateljé is not obliged to redeliver if delivery cannot take place due to incorrect or incomplete information. If Ateljé, at its discretion, agrees to a redelivery, any additional shipping costs will be borne by the Customer.
5. Any additional costs, such as customs duties, import taxes, or clearance fees, are the sole responsibility of the Customer, even if these arise in connection with a replacement or reshipment offered by Ateljé.
6. The risk of loss or damage to the Products passes to the Customer once the Products have been delivered to the address provided by the Customer or to another location designated for delivery, including delivery to neighbours or a designated pick-up point. From that moment, Ateljé is no longer liable for loss or damage to the delivered Products, without prejudice to any mandatory rights of the Customer under applicable consumer law.
7. International delivery is available to selected countries only. Delivery times and shipping costs may vary depending on the destination. Customers are responsible for verifying whether Ateljé delivers to their location before placing an order. For inquiries about international shipping, Customers may contact Ateljé via [insert appropriate email address]. Please allow additional time for international shipments, typically between 2 and 20 Business Days, depending on the destination.
8. Together with the delivered Product, Ateljé will provide the Customer, in writing or on another durable medium, with information regarding:
a) the contact details of Ateljé’s customer service for questions or complaints;
b) the conditions and procedure for exercising the right of withdrawal, or a clear statement if this right does not apply; and
c) information about after-sales service and applicable warranties.
Article 8 - Right of withdrawal
1. The Customer has the right to withdraw from the Agreement within fourteen (14) days after receiving the Product(s), without giving any reason. The withdrawal period starts on the day after the Customer, or a third party designated by the Customer, has received the Product. This Article does not affect the statutory rights of the Customer under applicable consumer protection law.
2. Return shipping costs are at the Customer’s expense. Standard delivery costs paid for the initial order will be reimbursed in accordance with applicable consumer law.
3. During this period the Customer will treat the Product and its packaging with care. He will only unpack to the extent that is necessary in order to determine whether he wishes to retain the Product. If the Customer wishes to exercise his right of withdrawal, then he will return the Product to Ateljé, with all associated components, and in the original condition and packaging, in accordance with the reasonable and clear instructions provided by Ateljé. The Customer is responsible for the return shipment and the associated shipping costs. We recommend returning Products with a registered or trackable shipping method and the return sytem Ateljé offers: Returnless.
5. Ateljé will refund the purchase price, including the original standard delivery costs (if applicable), within fourteen (14) days after receiving the returned Product or proof that the Product has been shipped back.
Products that are returned damaged, incomplete, or showing signs of use beyond what is necessary to establish their nature and functioning may be subject to a reduction in refund corresponding to the decrease in value of the Product. Damage to the packaging, other than signs of removing the seal, that diminishes the resale value of the Product may also result in a partial refund. Ateljé will inform the Customer of any such reduction after inspection of the returned Product. Phone cords are delivered in a sealed package. The Customer is permitted to open the seal, doing so will not be considered as damage to the Product.
6. Ateljé does not offer exchanges. If the Customer wishes to receive another Product, they must return the purchased Product, request a refund, and place a new order.
Article 9 - Price, Promotions and Gift cards
1. During the period of validity indicated in the offer, the prices of the products and/or services being offered will not be increased, except at a result of alterations in VAT-tariffs. Contrary to the previous paragraph, Ateljé may offer products or services at variable prices, if these are subject to fluctuations (in the financial market) over which Ateljé has no influence. The offer must refer to these fluctuations and the fact that any prices quoted are recommended prices. Prices quoted for products or services being offered include VAT.
2. All promotions, discounts and special offers are valid only while stocks last and subject to the specific terms and conditions as communicated on the Website or in connection with the relevant promotion. Ateljé reserves the right to modify, suspend or terminate any promotion at any time. If a Product that is subject to a promotion is unexpectedly unavailable, Ateljé reserves the right to cancel the order and refund any payments already made. By placing the Product in the Cart and submitting the order, the Customer acknowledges and accepts the applicable promotion, discount or special offer and the related terms and conditions.
3. Gift cards issued by Ateljé are valid for a period of two (2) years from the date of purchase, unless stated otherwise. Gift cards can be redeemed exclusively on the Ateljé website and may be used for one or multiple purchases until the remaining balance has been fully spent. Gift cards are non-refundable, cannot be exchanged for cash and may not be returned. Ateljé is not responsible for lost, stolen or damaged gift cards. After the expiration date, any remaining balance on the gift card will lapse.
Article 10 - Conformity and Guarantee
1. Ateljé warrants that its Products meet the reasonable expectations of quality and durability under normal use. This warranty covers manufacturing defects and faults that render the Product non-conforming at the time of delivery.
2. Given the nature of the Products, being: daily-use accessories such as phone cords and cases, Customers should take into account that signs of normal wear and tear may occur over time. Normal wear and tear includes, for example (but not limited to): minor scratches, discoloration, or slight loosening or stretching of cords resulting from regular use. Such wear and tear does not constitute a defect and is not covered under the commercial warranty.
3. Customers may reasonably expect the Products to remain free from wear and tear defects for at least three (3) months after delivery. This commercial warranty is provided in addition to, and does not limit or exclude, the statutory rights of the Customer under applicable consumer protection laws.
4. If the Customer discovers a defect, they must notify Ateljé as soon as reasonably possible and preferably within seven (7) days after receipt of the Product if the defect was immediately visible, or within seven (7) days after discovering the defect if it becomes apparent at a later stage.
5. Ateljé may choose between repairing or replacing the Product(s) unless one of these choices results in a cost that is disproportionately high for Ateljé. If a repair or replacement of the Product is not possible, the Customer entitled to a refund of the purchase price upon return of the Product. The return, replacement or reimbursement of the Product shall be carried out at no cost to the Customer.
Article 11 - Complaints procedure
1. Ateljé has implemented a complaints procedure and will deal with a complaint in accordance with this
complaints procedure. A Customer who has discovered a defect should submit to Ateljé, without delay, a comprehensive and clearly specified complaint about fulfilment of the purchase.
2. Complaints can be submitted to Ateljé by e-mail at info@shopatelje.com. A reply regarding complaints submitted to Ateljé will be provided within a period of 5 Business Days, calculating from the date of receipt. If a complaint is expected to require a longer period of time for processing, then Ateljé will reply within 5 Business Days, confirming receipt and indicating when the Customer can expect a more elaborate reply. Ateljé may ask the Customer to make pictures of the damaged Product and provide this to Ateljé, before the Customer is being asked to ship the Product(s).
Article 12 - Liability
1. Nothing in these Terms shall exclude or limit our liability with regard to any matter for which it would be unlawful to limit or exclude liability under applicable law.
2. Ateljé is not responsible for indirect losses, incidental, consequential or special losses or damageswhich are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control (force majeure), which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
3. Ateljé shall not be liable for:
a. minor deviations in colour, texture, finish or appearance of the Product(s), including differences caused by screen settings, lighting conditions or the nature of the materials used;
b. damage to products resulting from improper, careless or non-intended use, failure to follow care instructions, normal wear and tear, or inadequate maintenance or storage by the customer;
c. damage to personal property or other items of the Customer, including but not limited to mobile phones, clothing, bags or other accessories, arising from or in connection with the use of the Product.
4. Our maximum liability to you for any loss or damage arising in connection with your order shall be limited to the amount paid by the Customer for the specific product to which the liability relates.
Article 13 - Supply and implementation
1. Ateljé will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services. The place of delivery is deemed to be the address that the Customer makes known to Ateljé.
2. Ateljé will implement accepted orders with due care and within the statutory delivery period.If delivery is delayed, or if an order cannot be fulfilled, or only partially, the Customer will be informed about this, at the latest within one month after the order was placed. In that case, the Customer has a right to dissolve the Agreement, free of charge. In a case of dissolution as described in the previous paragraph, Ateljé will refund the Customer with the sum paid as quickly as possible, at the latest within 30 days after the dissolution. Should it prove impossible to deliver a Product that has been ordered, Ateljé will attempt to provide a replacement article. Ateljé will indicate, clearly and intelligibly, that a replacement article is being supplied, at the latest upon delivery. The right of withdrawal cannot be precluded in the event of replacement articles. Ateljé will be charged with the costs of return shipments.
Article 14 - Intellectual Property Rights
1. Ateljé holds all intellectual property rights to the website, its content (including - but not limited to - text, design, layout, brochures, catalogues images, Instagram and/or TikTok posts, and videos), the Product(s), the domain name, trademarks and trade names.
2. Any use of our intellectual property rights, including – but not limited to - copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the prior written permission of Ateljé.
3. We will hold you liable for all caused direct and indirect damages when you use of our intellectual property rights without our consent.
Article 15 - Privacy
Ateljé processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR). Further information about how Ateljé processes personal data can be found in the Privacy Policy available on the Website.
Article 16 - Force Majeure
If Ateljé is temporarily or permanently unable to fulfil the Agreement due to circumstances beyond its reasonable control, it will inform the Customer as soon as possible. Ateljé may postpone performance, offer a replacement Product, or terminate the Agreement without being liable for damages. In the event of termination, any amounts already paid by the Customer will be refunded.
Article 17 - Law and jurisdiction
The Terms and the contractual relations between Ateljé and you are subject to Dutch law. In the case of litigation, exclusive authority is attributed to the competent Dutch court in Amsterdam. We are nonetheless committed to finding an amicable solution before any judicial action.
